General Terms and Conditions eSIM Provider

1. Terms for the Use of eSIM

1.1. Validity of General Terms and Conditions
These General Terms and Conditions apply to all services provided by our company concerning the use of prepaid eSIMs. These terms are binding and enforceable when using our services. Deviations from these terms will only be accepted if expressly agreed upon in writing.

1.2. Description of Services
Our services include providing and managing eSIMs (electronic SIM cards) for mobile devices, allowing users access to mobile networks without a physical SIM card. Unlimited bundles offer 1GB of uncapped 5G data every 24 hours from the first use. After using the 1GB, unlimited data is available at reduced speeds for the remainder of the 24 hours.

1.3. Sale of eSIMs
We offer prepaid eSIMs that can be used in various regions and countries. These eSIMs are designed to provide customers with an easy and flexible way to access mobile data services.

1.4. Registration for Using Our Services
Customers must register and provide necessary personal information, such as name, address, and email, to use our services. This registration process is essential for activating and managing the eSIM services.

1.5. Our Obligations
We strive to provide the best services to our customers. Unfortunately, we cannot guarantee that everything will always run without interruptions or errors. However, we are committed to maintaining the quality of service as well as possible.

1.6. Customer Obligations
Customers are expected to use our services responsibly. Actions that are abusive, illegal, or fraudulent, or that disrupt the network, are strictly prohibited. Violation of these terms may lead to service suspension, with the customer remaining responsible for incurred costs.

1.7. Device Compatibility
Customers are responsible for ensuring that their devices are compatible with eSIM technology. Compatibility may vary depending on the provider and the country of origin of the device. The customer is responsible for checking the compatibility of their device based on the provided list at the time of purchase.


2. Registration and Activation

2.1. Registration Requirements
Customers must complete a registration process to access and use our eSIM services. This process is simple and designed to ensure a smooth and secure experience. The main requirements for registration are:

  • Personal Information: Customers must provide accurate and up-to-date personal information, including first name, last name, billing address, and a valid email address. This information is crucial for account creation and communication.
  • Account Creation: Customers create an account on our platform after providing the necessary information. This account manages purchases, tracks eSIM usage, and provides access to support.
  • Acceptance of Terms: Customers must read and accept our General Terms and Conditions during registration. This acceptance is a binding agreement in which the customer agrees to adhere to our policies and procedures.
  • Device Compatibility Check: Customers are responsible for ensuring that their device is compatible with eSIM technology. A list of compatible devices is available on our website. By proceeding with registration, the customer acknowledges that their device is compatible.

2.2. Purchase and Activation Process
After successful registration, customers can proceed with the purchase and activation of their eSIM:

  • eSIM Selection: Customers can view different eSIM options on our platform, each tailored to various needs and destinations.
  • Payment Process: After selecting the eSIM, customers can proceed to payment. We accept various payment methods, including Credit/Debit Cards, Google Pay, Apple Pay, Alipay, and iDeal. All transactions are securely processed; the payment currency is in euros, dollars, or other local currencies.
  • Delivery of eSIM: After purchase, the eSIM is delivered electronically. Customers receive an email with detailed instructions for installing and activating the eSIM. The eSIM can also be viewed under the “My eSIMs” tab on the customer account.
  • Activation: The activation of the eSIM is the responsibility of the customer. The process typically involves scanning a QR code and following simple steps. After activation, the eSIM is ready for use according to the chosen plan.
  • Support and Assistance: In case of issues during the registration or activation process, customers can contact our customer service for assistance. Our team is available 24/7 to ensure a smooth experience.


3. Payment and Financial Terms

3.1. Costs and Payment

  • Payment Terms: Services can be purchased using various payment methods, including Credit/Debit Cards, PayPal, Google Pay, Apple Pay, Alipay, and iDeal.
  • Currency: All transactions are processed in euros or US dollars (USD).
  • Security: Transactions are secure and processed through the established payment provider Stripe.
  • Costs: Prices are inclusive of all applicable taxes and fees unless otherwise stated.

3.2. Refunds and Cancellations

  • General Policy: eSIMs are one-time purchases and are non-refundable. This includes funds deposited into a users wallet. Customers are not entitled to a refund if their devices are not unlocked or if they are not compatible with eSIM technology. If any issues should occur, eSIM Provider will do everything to satisfy it’s customer.
  • Unlimited Bundles: Unlimited bundles have a limited speed after consuming a certain amount of data at maximum speed, also known as FUP (Fair Use Policy).
  • Fraudulent Use: eSIM Provider B.V. reserves the right to cancel purchases in cases of suspected fraud or spam usage.
  • Virtual Numbers: Virtual numbers do not work on WhatsApp and other similar services, and the customer is not entitled to a refund if they do not receive OTP codes for such services.


4. Legal and Compliance Matters

4.1. Applicable Law and Legal Compliance

  • Jurisdiction: The services provided are governed by and interpreted in accordance with the laws of the jurisdiction where the service provider is located. All legal actions or proceedings related to or arising from these terms are subject to the exclusive jurisdiction of the courts in this region.

4.2. Liability and Warranty

  • Service Availability: Although the service provider strives to keep the service available and operational, there is no guarantee of uninterrupted service. The provider is not liable for interruptions or lack of availability.
  • Warranty Disclaimer: Services are provided “as is” without any form of warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Limitation of Liability: The service provider is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.

Service Limitations: While we strive for uninterrupted service, we cannot guarantee that the service will always be available, timely, secure, or error-free. Changes to Terms: We reserve the right to modify these terms at any time. Changes will take effect immediately upon publication on our website. Continued use of our services after such changes constitutes acceptance of the new terms.

Notices: All notices to customers will be made via email, in the app itself, or by posting messages on our website. Notices will be deemed received 24 hours after sending the email, notification in the app, or posting on the website.
